Hamilton Academical Football Club expresses its deep disappointment at the Scottish Football Association’s decision not to grant the Club’s appeal on its recent Article 10 determination, which directly concerns our Director, Gerry Strain. This outcome is not only frustrating—it raises serious questions about fairness and the willingness of the governing body to engage constructively in resolving what is an undeniably challenging situation.
The decision communicated by the SFA stated that Gerry Strain had no right of appeal, despite the Club making lengthy and detailed submissions supported by legal arguments from Mark Lindsay KC. The response received was just over a single page and did not engage with or review the substantive points raised. This lack of meaningful consideration is deeply concerning.
The Club believes the SFA’s stance effectively forces Hamilton Academical Football Club toward costly and protracted legal proceedings, rather than exploring a more pragmatic and collaborative solution. At a time when the Club is working tirelessly to stabilise its finances and protect its future, this approach feels disproportionate and unhelpful.
Gerry Strain commented:
“I am profoundly disappointed by this decision, which relates to me personally. It is difficult to understand why the SFA is unwilling to reconsider its position and instead appears to be pushing us down a path of escalating legal action. Our preference has always been to resolve this matter constructively, and I remain open to dialogue with the Association to find a fair and workable solution.”
Strain also highlighted the personal impact of the decision:
“This determination affects not only my role but my reputation. I have acted with integrity and in the best interests of Hamilton Academical FC throughout. Any suggestion otherwise is deeply unfair and will be challenged.”
Despite these challenges, the Club is taking decisive steps to safeguard its financial stability. Measures are already in place to ensure operational continuity and to protect the interests of players, staff, and supporters. Gerry Strain added:
“Our focus remains on securing the future of Hamilton Academical Football Club. We are implementing robust financial measures and doing everything possible to keep the Club moving forward. This is a difficult period, but we will not allow it to define us.”
